Who we are

Unavoidable Marketing is a trading name of Validus Media Ltd, registered in England and Wales, company number 08013355. In this policy, “we”, “us” and “our” mean Validus Media Ltd, trading as Unavoidable Marketing. We decide how the personal data described here is used, which makes us its controller.

What we collect and why

When you get in touch

If you use our contact or quote form, email us, call us or message us on WhatsApp, we keep your name, business name, email address, phone number and whatever you tell us about your business and what you need. We use it to reply, to prepare a quote and to keep a record of our conversation. Our lawful basis is taking steps you have asked for before a contract, and our legitimate interest in answering enquiries.

When you book a call

Our booking page runs on Unavoidable CRM, a separate product built and run by Unavoidable Studio Ltd (company number 17367981). Unavoidable Studio Ltd handles your booking details for us, on our instructions, as our processor. We receive your name, email address, phone number and any notes you add, and use them to hold the call and send you reminders.

When you become a client

We keep your contact and billing details, the access you give us to accounts such as your Google Business Profile, Google Ads or website, and the information in those accounts that we need to do the work. Our lawful basis is our contract with you. We keep invoices and accounting records because the law requires it. Card and direct debit payments are handled by our payment providers, and we do not keep full card numbers.

When we contact businesses

We sometimes contact businesses about our services by email or phone, using business contact details that the business has published, for example on its website, Google Business Profile or directory listings. Our lawful basis is our legitimate interest in telling businesses about services that may help them. We check phone numbers against the Telephone Preference Service before we call. If you ask us to stop, we will stop straight away, and we keep a short note of your details only so that we do not contact you again.

When you visit our website

We use Google Analytics and Microsoft Clarity to understand how people use the site: the pages you visit, how long you stay, clicks and scrolling, your device and browser, your approximate location and how you found us. We use this to improve the site. Our security plugin, Wordfence, records IP addresses and visit details so that it can block attacks, which is in our legitimate interest in keeping the site safe. Some parts of our pages load from other providers, such as Google Fonts and our reviews widget from Trustindex, and those providers see your IP address so that they can deliver them. If you use the WhatsApp button, WhatsApp handles your message under its own privacy policy.

Cookies

Essential cookies keep the site secure and working. Analytics cookies from Google Analytics and Microsoft Clarity are not essential, and we only set them if you agree. You can change your choice at any time using the cookie settings on the site, or by deleting cookies in your browser.

Who we share it with

We never sell your data. We share it only with:

• Unavoidable Studio Ltd, for bookings made through Unavoidable CRM, as our processor;
• the providers that help us run the business, such as Google (email, documents and analytics), Microsoft (Clarity), our website host, and our phone, scheduling and automation tools;
• our bank, payment providers, accountant and professional advisers;
• HMRC, regulators or the police, where the law requires it.

When we manage accounts for a client on platforms such as Google or Facebook, those platforms also handle data under their own terms.

Transfers outside the UK

Some of these providers, including Google and Microsoft, may handle data in the United States or elsewhere outside the UK. Where they do, the transfer is covered by UK adequacy regulations, such as the UK Extension to the EU-US Data Privacy Framework, or by approved contract terms.

How long we keep it

• Enquiries that do not lead to work: up to two years after we last spoke.
• Client records, invoices and accounts: six years after the end of the financial year they relate to, as tax rules require.
• “Do not contact” notes: for as long as we need them to respect your request.
• Website analytics and security logs: for the periods set in Google Analytics, Microsoft Clarity and Wordfence, after which they are deleted automatically.

Your rights

You can ask us to give you a copy of your data, correct it, delete it, limit how we use it, or send it to you or another organisation in a usable format. You can object to how we use it, including stopping marketing at any time, and you can withdraw any consent you have given. Email andrew@unavoidablem.com and we will reply within one month. There is no charge.

If you are unhappy with how we have handled your data, please tell us first so we can put it right. You can also complain to the Information Commissioner’s Office at ico.org.uk/make-a-complaint or on 0303 123 1113.

Changes

If we change this policy, we will update this page and the date at the top.
